Agreement to Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you” or “Customer”) and Scrubs and Whiskers (“Company,” “we,” “us,” or “our”) governing your access to and use of scrubsandwhiskers.com and any related products, services, and features (collectively, the “Services”). Scrubs and Whiskers operates as an e-commerce print-on-demand store offering customprinted products.
By accessing, browsing, or purchasing from the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
Eligibility
You must be at least 18 years of age, or the age of majority in your jurisdiction, to make a purchase. By using the Services, you represent that you meet this requirement and that all information you provide is accurate and complete.
Accounts
You may browse and purchase without an account, though certain features may require registration. If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly at scrubsandwhiskers.co@gmail.com of any unauthorized use.
Products, Print-on-Demand, and Availability
Our products are printed on demand, meaning each item is produced specifically for your order after it is placed. As a result:
• Products are made to order and production times are in addition to shipping times.
• Slight variations in color, placement, sizing, and finish may occur between the on-screen preview and the final printed product and are considered normal, not defects.
• Product images are for illustration; actual items may vary slightly.
• We may modify, discontinue, or limit the availability of any product at any time without notice.
Orders and Acceptance
Your order constitutes an offer to purchase. All orders are subject to acceptance and availability, and we reserve the right to refuse or cancel any order for any reason, including suspected fraud, pricing errors, or unavailability. If we cancel an order after payment, we will issue a full refund for that order. Because items are printed on demand, orders generally cannot be changed or canceled once production has begun.
Pricing and Payment
All prices are listed in U.S. Dollars (USD) and are payable at the time of purchase. By placing an order, you agree to pay the listed price plus any applicable shipping charges and taxes.
• We strive for accuracy, but in the event of a pricing or typographical error, we reserve the right to cancel or correct the order and refund any amount charged.
• You authorize us and our payment processors to charge your payment method for the total order amount.
• You are responsible for providing accurate billing and shipping information.
Shipping and Delivery
Estimated production and delivery times are provided at checkout and are estimates only, not guarantees. Title and risk of loss pass to you upon delivery to the carrier. We are not responsible for delays caused by carriers, customs, incorrect shipping addresses provided by you, or events beyond our reasonable control. Any customs duties or import taxes on international orders are your responsibility.
Returns, Refunds, and Replacements
Because our products are custom-made to order, we do not accept returns or offer refunds for buyer's remorse, incorrect size selection, or minor variations described in Section 4. However, we stand behind the quality of our products:
• If your item arrives damaged, defective, or misprinted, contact us at scrubsandwhiskers.co@gmail.com within 30 days of delivery with your order number and a photo of the issue.
• Verified defective, damaged, or misprinted items are eligible for a free replacement or refund at our discretion
• We are unable to accommodate replacements for errors in information you provided at checkout (such as a wrong address or size).
Intellectual Property
All content on the Services, including designs, artwork, graphics, logos, text, and the Scrubs and Whiskers name, is owned by the Company or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from our designs without our written permission. We grant you a limited license to access and use the Services solely for browsing and making personal purchases.
Acceptable Use
You agree not to use the Services to violate any law, infringe any third-party right, transmit harmful code, attempt unauthorized access, scrape or copy content except as permitted by law, or interfere with the operation of the Services. We may suspend or restrict access to anyone who violates these Terms.
Third-Party Services
We rely on third-party providers for payment processing, printing, and fulfillment, and the Services may link to third-party sites we do not control. We are not responsible for the content, policies, or practices of any third party, and your dealings with them are at your own risk.
Disclaimers
THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, EXCEPT AS EXPRESSLY PROVIDED IN THESE TERMS OR REQUIRED BY LAW. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCRUBS AND WHISKERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.
Indemnification
You agree to indemnify and hold harmless the Company and its affiliates from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising from your use of the Services, your violation of these Terms, or your violation of any law or third-party right.
Governing Law and Disputes
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Services will be resolved exclusively in the state or federal courts located in Alameda County, California, and you consent to their personal jurisdiction.
Changes to These Terms
We may update these Terms from time to time. Your continued use after changes take effect constitutes acceptance of the revised Terms.
